Realizing that your marriage isn’t working means that you have to decide what you’re going to do. You can either try to work things out, or you can call it quits. In Kentucky, you also have a third option, which is known as divorce from bed and board, which is a legal separation.
If you choose to use the divorce from bed and board, it means that you can’t marry anyone else. The decree can be changed to a divorce if it remains in place for a full year. Some people choose this option because it gives them a chance to find out whether the split is what they want or not.
When you choose to divorce in Kentucky, you need to ensure that you meet specific requirements. The residency requirement for divorce in this state is that you either lived in the state or were stationed at a military installation in the state for at least 180 days before you file.
You must live in a different home than your ex for at least 60 days before the divorce is finalized. The alternative to this is that you can live in the same home but without sexual contact with each other for that same amount of time.
There isn’t a requirement for a reason for the divorce here. Instead, at least one party involved in the divorce has to believe that the marriage is irretrievably broken, so there isn’t any chance of the marriage working out.
